Bali Will Not Go Quietly

One of the most powerful men in Bali, Satria Naradha (left), stressed that Bali would not betray the republic by seceding from Indonesia. Instead, Bali would fight till the end any group that was trying to transformed the nation into a monolithic society based on certain religious belief.

"If Jakarta and Aceh want to betray the republic (by supressing religious freedom and multiculturalism) then we will let them go (from the republic). Bali will not go away, we will fight to keep this nation as a nation that respect religious freedom and celebrate multiculturalism," he said.

'My ancestors sacrifice their lives to build this republic. I and my fellow Balinese will not let this sacred heritage being ruined by a small group of people who want to impose their moral values on this nation," he added.

The owner of the influential Bali Post and BaliTV, stated that on Saturday before the members of the House of Representatives' Special Committee on Anti Pornography Bill led by Chairunissa(right, previously we mis-quoted her name as Yoyoh Yusroh, we sincerely apologized for the mistake). The committee visited Satria at his company's sprawling headquarter in west Denpasar.

"Bali may be as small as a bird, but as you know, bird flu can kill a strong man, " he warned.

Chairunissa, apparently stunned by Satria's point blank warning, could only nodded in apprehension.

Satria closed the meeting by presenting the committee with a special gift; two pieces of the Indonesia national flags.

"May these flags will always remind you on what does this republic really stand for," he said.

Over 1,000 people attended the Cultural Rally. Various traditional performing arts (the noisy Kecak, the sensuous Joged Bumbung etc), modern punk and reggae bands (Superman Is Dead, Lolot, Postman, Nanoe Biroe etc) , fashion shows, drag queen show and aerobic dances created a colorful, yet unified voice of defiance against the anti pornography bill.

Lebih dari 1000 orang menghadiri Aksi Budaya ini. Berbagai kesenian tradisional (Kecak yang riuh, Joged Bumbung yang sensual dsb), band-band punk dan reggae modern (Superman Is Dead, Lolot, Postman, Nanoe Biroe dsb), peragaan busana, pertunjukkan waria serta senam erobik menciptakan sebuah suara perlawanan terhadap RUU APP. Suara perlawanan yang meski penuh warna-warni namun teguh setia pada satu ide:perlawanan.

In the meeting held at the Bali Governor Office, across the street from the Cultural Rally main stage, the unified voice of the island's elites "enlightened" the puritan legislators on the real magnitude of the opposition.

Pada saat yang bersamaan, puluhan cendekiawan, pemimpin keagamaan dan tokoh masyarakat Bali menyatakan penolakan yang sama di depan 14 anggota Pansus RUU APP. Dalam sebuah pertemuan yang dilakukan di kantor Gubernur Bali, sepenyeberangan jalan dari panggung utama Aksi Budaya, suara penolakan yang teguh dan satu dari kelompok elit Bali "menyadarkan" para anggota dewan yang puritan itu tentang betapa besarnya perlawanan yang sedang mereka hadapi.

Today, March 3, we shows our defiance to the anti pornography bill by staging a vivacious cultural rally at Puputan Margarana Square in Renon.

The Temptation of Exemption

Following the Balinese’s loud rejection toward the ludicrous bill, a growing number of politicians, particularly from the Islamic parties, have tried to convinced the public that the bill would not in any way be harmful to the cultural heritage and religious belief. They eagerly cited Article 36 of the bill, claiming that it exempt religious ritual, art performance and sport activity from the snoopy moral police of the bill.

Well, to those who are being tempted by the exemption, I believe, a brutal word-by-word examination of the article is being called for.

Lets start with Article 36 (section 1, clause a), which provide exemption to:

“Costume and/or behavior in accordance with the traditional ethnic custom and/or culture, as long as the costume and/or behavior are related to a religious ritual”

It means that the exemption does not cover:

1. Traditional costume and manner that do not have any relation to a religious ritual.
2. Other important aspects of the religious ritual, such as language, sacred objects, offerings and sacred performances.

It means that the display of pretima (sacred effigy), such as Lingga Yoni, is not covered by the exemption. It means that the display of a bare-breasted statue of Goddess Durgha inside a temple would still be considered by the bill as a crime

Article 36 (section 1, clause b) gives an exemption to art performances. However, in the similar article (section 2), the bill explicitly stated that the exemption was extended only to art performances that are being held in “places/building set aside specifically to hold art performances ”.

Later on, the Article 37 (clause 1) specifically dictates that those “specific places” must acquire a license/ a permit from the government beforehand.

It means that the exemption does not cover art performances in the temple, private houses, road intersections and cemetery---the common occurrences in Bali. The bill will certainly kill the Balinese traditional art by suffocating the arts’ fluid, spontaneous and communal nature.

Yet, the most dangerous trap of this exemption lies in the fact that by accepting such exemption, we, actually, have consciously acknowledge and affirm the right of the state to intrude on, influence upon and impose its values on the most private and personal domain of its citizen; the freedom of aesthetic expression and the freedom of religious belief.

If you want to open the door widely for the state’s snoopy moral police, if you want the state to dictate the terms and ways of your relationship with God then, by all means, you should support the exemption, embrace the bill.

For those, who want to keep religion and arts as a matter of personal taste and private choice then, by all means, let’s close the door, lock it tight and swallow the key!

Why The Balinese Reject The Bill?

(Well, perhaps because the bill is simply ludicrous. Ludicrous bill needs no logical counter argument. It simply needs a fast rebuke and an instant rejection.)

Below is an excerpt from the Komponen Rakyat Bali’s statement of rejection. The delegation of Komponen Rakyat Bali presented the statement on Februari 21 to the chairman of the House of Representatives’s Special Committee on Pornography Bill.

The Balinese people reject the bill on the grounds:

1. The bill has failed to reflect and represent Indonesia as an open, tolerant society with a deep, profound respect to the unique social, cultural and religious values adhered by its different ethnic groups. The bill’s lack of understanding over the country rich, multicultural heritage is clearly visible in its narrow, superficial derogatory definition on and attitude toward the sensuality and sexuality of human body and of human’s aesthetic expression. The Balinese has never viewed sex and sexuality solely as the manifestation of human’s banal and carnal lust. Sex and sexuality are among the most important symbols in the Balinese religious and cultural cosmology. Sex and sexuality are viewed and respected as the symbolic representation of the divine power of creation and sustenance of the universe. The sacred religious object of worship Lingga-Yoni is the most obvious example of the symbolic importance of sex and sexuality. Lingga-Yoni is a three-dimensional stone effigy that resembles and, in fact, represent the union between a phallus and a vulva. The Balinese belief that Lingga-Yoni symbolized the union between Siwa and Uma, between Purusha (the masculine energy of the universe) and Pradhana (the feminine energy of the universe); a sacred union that gives birth and sustain the universe and mankind. In this context, the bill will prevent the Balinese from celebrating their cultural heritage and religious belief. Moreover, the spirit of the bill has clearly betrayed the Bhineka Tunggal Ika (Unity in Diversity) principle; one of our nation’s main pillars.
2. The bill has failed to display an appropriate respect and sensitivity toward the female members of our society. The bill has repeatedly, although implicitly, portrayed the woman and her (uncovered) parts of body as the cause of the moral decadence. Following this absurd logic, the bill dictated that the woman must cover her sensual body parts, which, in the definition of the bill, means nearly all of her body parts, to prevent such decadence. The Balinese refuses to acknowledge, let alone to accept, any legal product that threat their mothers and sisters in such a demeaning way.
3. The state has already had several laws, which provided a sufficient legal response to sexual-related and pornography-related crimes. Those laws are the Criminal Code, Law on Press, Law on Broadcasting, Law on National Motion Picture, Law on Children Protection and Law on Domestic Violence. There is no actual need or urgency for the state to draft a new law that specifically deal with pornography. The members of the House of Representatives should pay more attention to real, pressing problems of poverty, economic uncertainty and education stagnation instead of drafting an absurd law that will adversely affect the integrity of our nation.

Setelah mempertimbangkan Rancangan Undang Undang Anti Pornografi dan Pornoaksi, kami yang namanya terdaftar dibawah ini sebagai bagian dari masyarakat Bali yang berada di New York dan sekitarnya menyatakan sikap bulat untuk menolak tegas Rancangan Undang Undang Anti Pornografi dan Pornoaksi dengan alasan sebagai berikut.

• Kami menilai bahwa RUU ini tidak mengakui dan menghormati adanya keragaman nilai nilai sosial, budaya, dan agama yang ada di Indonesia.
• Kami menilai bahwa RUU ini tidak dapat memberikan definisi dan batasan pornografi dan pornoaksi yang jelas sehingga dapat mengekang kebebasan berkreatifitas dan beraktifitas setiap insan di Indonesia.
• Kami menilai bahwa RUU ini sangat mengekang kebebasan masyarakat Bali dalam mengungkapkan nilai nilai agama dan budaya melalui kesenian.
• Kami menilai bahwa RUU ini sangat mengekang kebebasan pers.
• Kami menilai bahwa RUU ini dirancang dari sudut pandang kaum laki laki sehingga tidak menghargai hak hak wanita dan anak anak.
• Walaupun ada tujuan dari RUU ini untuk mengatasi problema moralitas bangsa, kami menilai bahwa RUU ini tidak efektif dalam mencegah aksi aksi amoral (bom bunuh diri) yang terjadi di Indonesia belakangan ini.
• Kami menilai RUU ini tidak perlu karena perangkat hukum yang sekarang ada sudah dapat mengatasi masalah masalah yang menyangkut kesusilaan. Perihal pornografi dan pornoaksi sudah diatur dalam KUHP.

Sikap kami ini merupakan dukungan penuh atas hasil perumusan Semiloka RUU Antipornografi dan Pornoaksi yang diselenggarakan oleh Yayasan Sandi Murti Indonesia pada tanggal 11 Februari 2006 di Denpasar, Bali.

1. Para seniman (perupa) dan budayawan menolak RUU Anti Pornografi dan Pornoaksi, karena RUU APP tersebut tidak relevan untuk diterapkan di Indonesia. Kalau memang undang-undang tersebut dipaksakan harus ada, lembaga Legislatif diharapkan merevisi RUU APP tersebut dengan memandang budaya yang majemuk di Indonesia (Bhineka Tunggal Ika).
2. Khusus bagi masyarakat Bali, RUU APP ini sangat merugikan dan membawa kemunduran. Mengingat akar dan unsur yang membentuk kebudayaan Bali mempergunakan Lingga Yoni, Rwa Bhineda yang dalam manifestasinya masih mempergunakan bentuk-bentuk visualisasi alat kelamin pria dan wanita (Phalus dan Vagiana), maupun penonjolan-penonjolan anggota badan wanita seperti payudara, pinggul dan pantat dalam pandangan kesuburan atau sebagai lambang kesuburan bukan eksploitasi nafsu seksual. Mengingat dan menimbang hal tersebut jangan diartikan kebudayaan Bali adalah kebudayaan porno dalam pengertian maksiat atau jahat dan nantinya dengan adanya undang-undang anti pornografi dapat berdampak negatif terhadap kebudayaan dan kebiasaan masyarakat Bali. Selain itu RUU APP ini juga mendiskriminasi kaum wanita karena pasal-pasalnya mengekang kemerdekaan kaum wanita dan memberikan stigma negatif terhadap kaum perempuan.
3. Begitu mendasarnya dampak dari RUU APP bagi seniman Perupa dan budayawan dalam berkreatifitas maupun melestarikan kebudayaan peninggalan leluhur. Hal ini akan berdampak sama dengan terorisme bagi kereatifitas seniman maupun kebudayaan Bali karena itu dimohon agar lembaga Legislatif maupun Eksekutif membatalkan RUU APP tersebut sebelum menjadi musibah bagi kesenian dan kebudayaan yang masih milik bangsa Indonesia juga.
4. Masyarakat seni dan budaya mempertanyakan apakah yang melatar belakangi RUU APP tersebut sehingga dianggap perlu bagi Indonesia sekarang, ataukah ada kepentingan kelompok tertentu (mayoritas) ataupun gerakan ekstrim kanan dibalik RUU APP tersebut. Karena seakan-akan RUU APP tersebut sangat perlu bagi kondisi indonesia saat ini yang serba ditimpa bencana nasional seperti penanganan pasca bencana alam maupun wabah endemi penyakit seperti demam berdarah maupun wabah penyakit internasional seperti flu burung yang jelas-jelas lebih perlu dibuatkan aturan atau perundangan bagi nasib mereka. Belum lagi dampak kebijakan pemerintah yang memberatkan rakyat seperti kenaikan harga BBM dan TDL yang dapat berdampak pada peningkatan pengangguran dan kemerosotan perekonomian. Pada intinya bangsa kita lebih takut pada pornografi daripada kelaparan, penyakit maupun pengangguran.
5. Mari kita menengok kembali Pancasila maupun semangat kebhinekaan budaya yang membentuk masyarakat dengan pandangan berbeda-beda tetapi menyatukan bangsa kita, bila tidak mendapat perhatian lembaga eksekutif maupun legislatif dapat menimbulkan perpecahan maupun disintegrasi bangsa. Masih banyak suku maupun budaya di indonesia yang memandang ketelanjangan bukan sebagai pornografi, tetapi sebagai bagian dari kehidupan sehari hari mereka.
